THE LAND
The land is to be let in 10 separate lots which can be seen clearly on the attached letting plan. The lot sizes and field numbers are shown in the table below:

THE TERM
A 6 year Farm Business Tenancy will be granted from the 1st January 2023 to the 31st December 2028.

RENT
The rent will be payable half yearly in advance by standing order on the 1st January and the 1st June each calendar year. For the avoidance of doubt the first rental payment will be due on the 1st January 2023.

RENT REVIEWS
The rent will be reviewed at three yearly intervals from the commencement date.

REPAIRS
The repair clause within the tenancy will require the Tenant to put the holding into, and keep in, a good state of repair. This includes boundaries, becks and gutters with all grassland being kept in good heart in accordance with the rules of Good Husbandry as set out in the Tenancy Agreement.

CROPPING AT THE START OF THE AGREEMENT
Lots 1 to 8 at present are sown with various crops. If not now grass these lots will be sown down to grass for the new Tenant with a long term seed mixture, ready for 1st January 2023 start date.
Lot 9 will be let as ploughed land with no crop sown upon it. Lot 10 consists of two parcels of land, parcel 4876 will be sown down to grassland and parcel 5971 will be ploughed land with no crop sown in it at the start of the Tenancy Agreement.
FENCES
At the tenancy commencement date of the 1st January 2023 all external field boundaries that are not fenced at present will be fenced, by the outgoing tenant, so they are capable of turning cattle. The minimum required specification for these fences is treated posts at 6m centres with one strand of barbed wire. It is the intention that this specification of fencing will form the minimum base requirement for the fencing in the new Farm Business Tenancy that will be granted.

WATER
The Tenant for each lot of land is responsible for paying for all metered and trough rate water usage. In the event of any dispute C & D Rural as the Landlord’s Agent will determine and fix the amount paid.

BASIC PAYMENT SCHEME (BPS)
All the land at Wiggonby lies outwith the Severely Disadvantaged Area for the purposes of a Basis Payment Scheme (BPS).

Only Lots 5 and 6 have BPS Entitlements included with them. The transfer of these entitlements will be made once the Farm Business Tenancy has been signed and the BPS transfer online system is open in 2023. This will allow the Tenant to utilise them for the purposes of the BPS claim in 2023.

It is the responsibility of the successful Tenant to ensure that they are eligible to acquire the entitlements under the terms of the BPS scheme. Transfers will be made in accordance with the Regulations for the scheme and will be carried out as soon as Scheme Regulations permit by C & D Rural for which a fee of £200 plus VAT will be payable by each transferee. FOR THE AVOIDANCE OF DOUBT LOTS 1, 2, 3, 7, 8, 9 and lot 10 DO NOT HAVE ANY BASIC PAYMENT SCHEME ENTITLEMENTS ATTACHED TO THEM AND NONE WILL BE TRANSFERRED TO THE TENANTS OF THESE LOTS OF LAND.

NITRATE VULNERABLE ZONE (NVZ)
All the land offered to let lies within the Nitrate Vulnerable Zone apart from fields 6972 and 7389 of Lot 9 which lie outside the NVZ zone.

INSURANCE
The Tenants will be responsible for all insurance.

SUB-LETTING/ASSIGNMENT
There is to be no sub-letting or assignment permitted.

PLANS & SCHEDULES
The plans attached to these particulars are based on Promap maps and are for reference only. Tenants will have deemed to have satisfied themselves as to the land and schedule.

AUCTION
The lots are to be offered to be let by Public Auction, subject to them not being previously let or withdrawn and may be subject to a reserve price. The auctioneers reserve the right to alter the order in which the lots are offered. Any changes in the particulars will be notified at the auction prior to offering the lots to let. We would be pleased to answer any questions you have regarding the Farm Business Tenancy Agreements prior to the auction day and before offering the lots to let, but it will be assumed at the auction that you have full knowledge of the documentation, the land and the implications of entering into the Farm Business Tenancy Agreements.

TENANCY AGREEMENT
The proposed Tenancy Agreements will be available for inspection at the offices of C & D Rural, Townfoot, Longtown. All detailed questions regarding the contents of these particulars or the Tenancy Agreements should be referred to Bruce Murray at C & D Rural.

Please note on the day of the auction all successful Tenants will be required to sign a Notice of Creation which will be available for inspection at the offices of C & D Rural in Longtown.

COSTS
The Tenant is to pay the sum of £150 plus VAT per lot towards the Landlords costs of preparing the Tenancy Agreements. This payment is to be made by the successful tenants when demanded, but before the commencement date of the 1st January 2023.
