The land is situated at Nithsdale View Thornhill, opposite the former auction mart. The position of the land is shown circled in red on the attached location plan.
The land extends to approximately 10.6 acres (4.3 hectares) in area and is offered for sale by public auction as a whole.
Currently half is in good quality long term grass and half is stubble. The land has good access and frontage to the public road and the fields are watered from field troughs fed from the mains supply and charged on an annual trough basis.
Basic Payment Scheme
The land is all identified on the Scottish Government’s indicative map as being within Payment Region 1 for the purposes of the Basic Payment Scheme.
No Entitlements are included in the sale.
Basic Payment was claimed on the land in 2018.
The ownership’s of the boundaries, as far as they are known, are mutual.
Sporting and Mineral Rights
The sporting and mineral rights, insofar as they are owned by the vendor, are included in the sale.
The land is included in a Nitrogen Vulnerable Zone.
Wayleaves, Easements and Rights of Way
The land is sold subject to and with the benefit of all reservations, easements, rights of way and other matters, whether public or private and whether constituted in the title deeds or not.

Method of Sale The land will be offered for sale in one lot as a whole and will be sold subject to an undisclosed reserve price. Any changes to the particulars will be made clear at the auction and those unfamiliar with the methods adopted in a public auction should seek advice, prior to bidding, from the selling agents.
Conditions of Sale & Auction Pack
The Purchaser(s) will be required to sign a contract for the purchase of the land and pay a 10% deposit on the purchase price immediately after the auction. The solicitor’s auction pack will contain a copy of the contracts together with any special conditions of sale and will be available for inspection at the offices of the sole selling agents at Lakeside, Townfoot, Longtown, Carlisle, CA6 5LY or at the Auction Mart, Huntingdon Road, Dumfries DG1 1NF, as well as at the the office of the vendor’s solicitor, during normal office hours for seven days prior to the auction. Prospective purchasers will be deemed to have full knowledge of these conditions and the same will not be read out at the sale.
Money Laundering Regulations
All prospective buyers should be aware in order to be in a position to bid at the auction they must first undergo checks in connection with Money Laundering Obligations as part of the Money Laundering Regulations (The Money Laundering Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017). All parties considering bidding must call into our office prior to the auction and provide photographic ID, i.e. a passport or photographic driving licence and proof of address i.e. council tax or utility bill for copying.
Vacant possession of the land will be given upon completion of the sale on Friday 26th April 2019 or earlier if payment is made in full and by mutual agreement with the vendor’s solicitor.
Access for cultivation and re seeding will be given immediately after receipt of the deposit.
